When to issue 1099s?

$600??

If you paid a vendor more than $600...

...you MIGHT owe them (and the IRS) a 1099!!

And that is due: January 31!

You might be thinking to yourself...

...why do I care? This is a pain!

Reason to Issue 1099s:

  • If you do NOT issue the 1099 and you are audited, the IRS will NOT allow you to take the deduction.

    • You read that correctly...you pay your friend $10,000 last year to do your videography...and don't issue the 1099, you will NOT be allowed to deduct that business expense.

  • IRS Penalties are $50 - $290 (depending on how late) per missing 1099

    • it's much cheaper to issue them!

When you do NOT need to send a 1099:

  • Personal Expenses (Not related to business)

  • Payment was made to an Incorporated business

    • S-Corporations & C-Corporations

    • LLCs that are taxed as S-Corporations

    • EXCEPTION: Incorporated Law Firms...still need to send them a 1099

  • Total annual payments less than $600

So review your expenses, and determine which vendors will require a 1099.

After you determine, the "WHO" is owed a 1099...

...Next, determine "HOW" you paid that vendor.

This is critical because depending on how you paid them...

...the 1099 might be sent on your behalf.

When 1099s are sent on your behalf:

  • Payments send through a Payment Processor such as

    • Credit Cards

    • Debit Cards

    • Paypal & Venmo (when marked business services)

If you via paid cash, check, bank ACH, or Zelle...

...YOU must issue the 1099 to the Vendor & IRS.

This is why I am a big advocate for using payment processors!

It is one less task on your plate as a business owner.
